Terms and Conditions

erictorii.com (the “Site”) is the personal portfolio and studio site of Eric Torii (“I,” “me,” or “my”). By accessing or using the Site, joining a list, downloading a resource, or booking a session, you agree to these Terms and Conditions (the “Terms”). If you do not agree, please do not use the Site.

I operate the Site as a sole individual. It exists to show my design and product work, share writing and free resources, and open conversations about collaboration. From time to time the Site may offer additional things — including a design-work waitlist, an email newsletter, downloadable resources, and paid one-on-one sessions.

Availability, scope, pricing, and features shown on the Site are illustrative and may change or be discontinued at any time. Nothing on the Site is a binding offer to provide services, and any paid engagement is governed by the terms agreed at the time of booking or purchase.

The Site is intended for a general adult and professional audience. It is not directed to children, and you should not submit an email address or other personal information if you are under 13 (or under 16 where a higher age of digital consent applies). By booking a paid session you confirm that you are at least 18, or that you have permission from a parent or guardian who accepts these Terms on your behalf.

If you submit your email address — for example to join the design-work waitlist or to subscribe to the newsletter — you are asking me to contact you at that address for the purpose you selected. Depending on what you signed up for, that may include updates about availability, new work, resources, and occasional related messages.

You can opt out at any time using the unsubscribe link in any email, or by contacting me directly. Transactional messages tied to something you requested — such as confirming a booking or delivering a download — may still be sent even after you unsubscribe from marketing emails.

I sometimes offer free downloadable resources in exchange for your email address. These are provided for your own personal and professional use. You may use them for that purpose, but unless a resource states otherwise you may not resell, republish, or redistribute it, or present it as your own.

Free resources are provided as-is, without any warranty, and I may update, change, or withdraw them at any time.

I may offer paid one-on-one sessions, such as Mandarin coaching, from time to time. When I do, the following applies:

• Scheduling and payment. Sessions are booked through a third-party scheduling tool, and payment is handled by a third-party payment processor. Your use of those tools is subject to their own terms and privacy policies. I do not receive or store your full payment-card details.
• Rescheduling and no-shows. Please reschedule or cancel in advance using the booking tool where possible. Sessions missed without reasonable notice, or where you do not attend, may be treated as delivered and are generally non-refundable.
• Refunds. Refunds are handled at my reasonable discretion, taking into account the circumstances and any notice given. Nothing here limits any refund right you may have that cannot be waived under applicable law.
• Nature of the sessions. Sessions are informal language coaching and conversation practice offered from my own experience. They are not accredited instruction, and I make no claim of any professional teaching license, certification, or credential. Results depend on many factors and are not guaranteed.

Any specific booking terms presented at the time you book control if they conflict with this section.

You agree not to:

• use the Site unlawfully, or in a way that infringes the rights of others;
• disrupt, overload, or attempt to gain unauthorized access to the Site or the systems and networks behind it;
• scrape, harvest, or bulk-collect content or data from the Site except as expressly permitted;
• submit false, misleading, or another person’s information through any form; or
• introduce malware or otherwise interfere with the Site’s operation or security.

Except where noted, everything on the Site — copy, layout, typography, logos, photography, artwork, portfolio work, and downloadable resources — is owned by me or my licensors and is protected by intellectual- property laws. You may view the Site and share links to it freely. You may not reproduce, redistribute, sell, or create derivative works from its content without my prior written permission, except where the law allows or a resource’s own terms grant it.

The Site links out to third-party platforms — for example Instagram, TikTok, LinkedIn, and GitHub — and relies on third-party providers to operate, including Vercel for hosting and an email delivery provider for messages. I do not control these services and am not responsible for their content, policies, or practices. A link does not imply endorsement, and your use of any third-party service is governed by that service’s own terms.

The Site may also link to rikai.cloud, which is a separate product with its own terms and privacy policy. These Terms do not cover rikai.cloud; your use of that product is governed solely by its own terms.

The Site, its content, and any free resources are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information or session content will meet your requirements or produce any particular result.

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, its resources, or its services. My total liability for any claim relating to the Site will not exceed the greater of the amount you paid me, if any, for the service giving rise to the claim, or USD 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold me harmless from any claims, damages, losses, and reasonable expenses (including legal fees) arising from your misuse of the Site, your violation of these Terms, or your infringement of any law or third-party right.

I may suspend, restrict, or end your access to the Site or any offering at any time, with or without notice, including if I believe you have violated these Terms. Provisions that by their nature should survive — such as intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply after any termination.

I may update these Terms from time to time as the Site and its offerings evolve. The effective date above reflects the current version. Material changes will be posted here, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute arising from these Terms or the Site, except where applicable law entitles you to bring a claim elsewhere.

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
